Understanding Military Law and Its Unique Justice System

The Uniform Code of Military Justice (UCMJ) is the legal foundation that governs all branches of the U.S. military, including the United States Marine Corps. Established by the federal government, the military code of justice outlines the standards of conduct expected from service members and provides the framework for addressing violations of military law.

From active duty personnel to those who are honorably discharged, the UCMJ applies to all individuals under military jurisdiction. It encompasses various proceedings, including summary court-martials, which handle minor offenses, and extends to more severe federal cases involving serious criminal activity.

In any case, a strong defense is crucial when facing allegations under the UCMJ to protect a service member’s career, benefits, and honor while serving their country.

Marine Corps Court Martial

The military justice system operates through specialized courts and procedures that are distinct from civilian legal proceedings. These proceedings are called courts martial, of which there are three different levels depending on the severity of the crime in question: summary, special, and general. Among these, a general court-martial (GCM) represents the most serious type of military trial, reserved for major offenses such as desertion (Article 89 of the UCMJ), rape and sexual assault in the military (Article 120 of the UCMJ), and other grave misconduct. This trial is conducted under the authority of senior defense counsel, a military judge, and trial counsel, ensuring that proceedings are handled with the strict discipline and structure expected within the military.

A special court-martial (SPCM) serves as the intermediate level of military court-martial, similar to a civilian misdemeanor court. Special court-martial proceedings involve a judge, defense counsel, and prosecution, with punishments tailored to the military context. Criminal offenses under the UCMJ that might warrant a SPCM include larceny (Article 121 of the UCMJ), assault (Article 128 of the UCMJ), and drug-related charges such as possession or use (Article 112a of the UCMJ).

A summary court-martial (SCM) is the lowest level of military court-martial, reserved for minor offenses that exceed the scope of nonjudicial punishment but do not warrant a higher-level trial. Common charges in a summary court-martial include failure to report (AWOL under UCMJ Article 86), disrespect toward a superior officer (Article 89 of the UCMJ), and failure to obey orders (Article 92 of the UCMJ). SCMs are conducted by a single officer who acts as judge, prosecutor, and defense counsel, but service members are required to represent themselves in these cases, adding a unique challenge to the process.

The impact of a military court conviction extends far beyond the courtroom, influencing every aspect of a service member’s life. From their ability to serve honorably to their potential for reintegration into civilian life, the consequences are profound. This makes it critical to approach these cases with thorough preparation and legal representation from an experienced court-martial lawyer like Aden Wilkie.

Defending Marines Against Various Criminal Charges

At The Wilkie Law Group, our military defense attorneys defend clients against a range of violations, from drug and alcohol-related crimes to failure to report and beyond.

Drug-Related Offenses

Common drug-related charges in the Marine Corps include drug possession, distribution, and unauthorized use of prescription drugs. Cases involving illegal substances are taken very seriously in the armed forces, and convictions may lead to severe penalties, including dishonorable discharge, imprisonment, and forfeiture of benefits. With the guidance of an experienced attorney, however, accused Marines can explore all available legal options to fight these charges head-on.

Assault and Violent Crimes

Charges such as assault, battery, or domestic violence are also adjudicated under military law and may involve intense court-martial proceedings. Potential consequences include confinement, dishonorable discharge, and loss of future civilian employment opportunities. In these cases especially, a skilled Jacksonville criminal defense attorney like Aden Wilkie is critical to building a strong defense.

Sexual Assault and Harassment

The military enforces strict policies regarding sexual assault, rape, and harassment, reflecting heightened awareness of these offenses within the government. Penalties for a conviction include long-term imprisonment, sex offender registration, and permanent discharge, making strong defense counsel essential.

AWOL/Desertion

Failing to report for duty or abandoning a post, whether temporarily or permanently, is a serious offense in the armed forces. Penalties can include imprisonment, dishonorable discharge, and forfeiture of pay, with significant impacts on a Marine’s career and reputation.

Disobedience and Insubordination

Failure to obey a direct order, disrespecting a superior officer, and similar insubordination offenses under the UCMJ are also common types of cases we handle. Consequences range from non-judicial punishment to courts martial, potentially resulting in confinement or discharge. If you’re facing these charges, an experienced Marine Corps criminal defense lawyer on our team can help you understand your legal options.

Fraud and Theft

Fraudulent claims, theft of military property, or financial misconduct can also lead to serious criminal charges in the Marines. These offenses carry significant penalties, such as prison time, dishonorable discharge, and loss of military benefits. A military lawyer can craft an aggressive defense to help minimize the fallout.

Hazing and Maltreatment

Military hazing, bullying, or maltreatment of fellow service members violates military policies and can lead to severe disciplinary actions. Penalties may include reduction in rank, confinement, and forfeiture of pay. In such cases, it’s incredibly important to take these allegations seriously and equip yourself with knowledgeable defense counsel to protect your rights and career.

And an unfavorable outcome could result in loss of a job, retirement, healthcare, possible GI Bill, etc., all of which if added up is worth a considerable amount of money. And while outcomes cannot be guaranteed – you only get one opportunity to deal with the problem, why not do it with the help of a paid professional. In hiring The Wilkie Law Group, you are paying for tailored strategy, control of the courtroom, advanced negotiation skills, experience and commitment to achieve the best possible outcome.

  • When you become aware of being under investigation or merely approached by authorities wishing to interview or speak with you about a matter, call our office for advice. Don’t make any statements to law enforcement or anyone, including friends and social media. We can help you determine the severity of the issue and whether it serves your interests to cooperate versus maintain your silence. In many cases it is not in your legal interests to speak with those investigating you – even if you are innocent and just want to “clear things up.” Either way an immediate decision after consultation and advice from a qualified attorney on how best to protect your rights is critical.

  • All types of cases from assisting as early as the investigative stage to defending you at a fully contested trial and everything in between. The Wilkie Law Group is unique in its ability to defend your rights in both the civilian and military courtrooms.

We handle criminal misdemeanor and felony, domestic crimes, DWI, and military cases. Contact our office so we can assess your case and give you a unique customized legal strategy.

  • If you’ve been arrested or charged with a crime, you need to speak with an experienced lawyer as soon as possible to discuss your options. With over 20 years of legal and military experience Aden Wilkie will apply his knowledge and expertise to defend your legal rights. Regardless of whether you’re accused of a relatively minor offense or a serious felony, a conviction could land you in jail, cost a great deal of time and money, leave you with a permanent criminal record and ruin your reputation.

Your defense is our highest priority. The Wilkie Law Group has no competing interests or fear of “rocking the boat” to interfere with zealously defending your rights. The prosecution will treat your case differently when they know you have retained an aggressive, experienced attorney with a winning record who isn’t afraid of the courtroom.

The Wilkie Law Group provides you with a seasoned, realistic evaluation of the short and long-term legal consequences of your case. We listen to your concerns and can help guide you every step of the way.

  • First, do not panic being accused of something is a long way from being convicted of a crime. However, in today’s world it can be difficult when being accused in some people’s minds equals guilt. But you enjoy a presumption of innocence that is absolute and something that you should never forget. Unfortunately, people have been known to wrongfully accuse people of many types of crimes even something as serious as rape. So, just because someone said you did it does not make it so.

Second, stop talking to anyone other than your lawyer about the case or allegations. Any attorney you hire has confidential relationship with you and the things you discuss together are protected by the attorney-client privilege. The same cannot be said for your conversations, with your parents, significant other and social media. If you are military, you also need to monitor your conversations with barracks buddies and especially the chain of command.

Third, stay far away from the party who made the claim against you. Be polite and professional, just do not talk to them, be alone, or communicate with them in any way.

Finally, call our office immediately, so we can begin to defend you from the allegations and advise you through the process.

  • Convictions for North Carolina DWI cases can lead to license suspension, fines, jail time, and long-term damage to your record, but you don’t have to face it alone. Our law firm provides aggressive DWI defense strategies to protect your freedom and driving privileges.

Because of Aden Wilkie’s knowledge of how sobriety tests should be administered, if the officer made a mistake or skipped a step, Aden can spot it and use it to fight the prosecution’s case. These errors may impact the prosecution’s evidence and can be the difference between a DWI conviction and a case being dismissed or found not guilty.

Whether this is your first offense or you have a prior DWI on your record, having an experienced DWI defense lawyer from the beginning is key to a successful case outcome.
