North Carolina prosecutes several categories of fraud-related conduct as felonies. Understanding the distinctions matters because the classification drives sentencing exposure and shapes the defense strategy.

Common fraud charges include:

• Obtaining property by false pretenses (N.C.G.S. 14-100): This charge requires proof of a knowing and calculated false representation made with intent to defraud, on which the victim relied to hand over money, property, or something else of value. It’s a Class C felony when the value involved reaches $100,000 or more, and a Class H felony below that threshold.
• Embezzlement (N.C.G.S. 14-90): This statute applies to people in positions of trust, such as employees, corporate agents, or fiduciaries, who misappropriate property they received through that role. The same $100,000 threshold applies: Class C above it, Class H below.
• Financial identity theft (N.C.G.S. 14-113.20): Knowingly using another person’s identifying information for financial gain or to avoid legal consequences is generally a Class G felony, elevated to Class F when aggravating factors such as multiple victims are present.
